Data protection policy

As a recruitment company Active Apparel Recruitment processes personal data in relation to workseekers / candidates, individual client contacts and its own staff, and are committed to respecting private and confidential personal data. This policy sets out the basis on which Active Apparel Recruitment abides by the principles of the Data Protection Act 1998.

For the purpose of the Data Protection Act 1998 (the Act), the Data Controller is Active Apparel Recruitment of The Town Hall, Hebden Bridge, West Yorkshire, HX7 7BY. Our nominated representative for the purpose of the Act is Julia Woodhouse, Managing Director.

'Personal data' means data which relates to an individual who can be identified from the data or from the data together with other information, which is in possession of Active Apparel Recruitment. 'Processing' means obtaining, recording or holding data, or carrying out any operation on the data, including organising, adapting and amending the data, retrieval, consultation and use of the data, disclosing and erasure or destruction of the data.

Active Apparel Recruitment holds data on individuals for the following general purposes:-

  • Administration and processing of work-seekers personal data for the purposes of work-finding services
  • Account and records
  • Advertising, marketing and public relations
  • Staff administration

Active Apparel Recruitment will process data in accordance with the principles of data protection requiring that data shall be fairly and lawfully processed, processed for limited purposes, accurate, relevant and not excessive, not kept longer than necessary, kept securely, not transferred to countries outside of the European Economic Area without adequate protection, and processed in accordance with the data subjects rights.

Candidate Information

Active Apparel Recruitment may collect and process the following data about candidates:-

  • Information about identity, nationality, immigration status if applicable and contact details
  • Information about training and experience, qualifications and copies of any certificates provided
  • Information provided to Active Apparel Recruitment by telephone, email and in interviews, as well as correspondence relating to work-seeking and career progression
  • Information in relation to positions being sought and names of clients to whom the candidate is introduced along with the date of introduction
  • Information passed to Active Apparel Recruitment by clients resulting from their taking up references or from background checks they perform
  • Details of engagements that result from Active Apparel Recruitment's introductions, copies of contracts, and information on the term and terminations of such contracts

Data will be reviewed on a regular basis to ensure that it is accurate and relevant. Data will only be processed with the consent of the person whose data is held. By instructing Active Apparel Recruitment to look for work and providing personal data contained in a CV, candidates will be giving consent to processing their details for work-finding purposes. If Active Apparel Recruitment intends to use data for any other purpose then specific consent must be obtained.

Client Information

Information provided by clients will be treated in the same manner as candidate data, with the highest standards of confidentiality being maintained. Active Apparel Recruitment will only provide information to candidates regarding an open vacancy which the client has agreed can be shared.

Data Storage

Data will be stored in Active Apparel Recruitment's database and in hard copy files, and all reasonably necessary steps will be taken to ensure data is treated securely and in accordance with this policy. All information provided is stored on secure servers or in either locked or attended offices.

The information held about candidates will be utilised by Active Apparel Recruitment to provide notice to candidates on positions with clients and work opportunities which may be of interest.

Active Apparel Recruitment will keep data for at least a year after it is provided in accordance with Section 29 of Employment Agencies and Employment Business Regulations 2003. At any point after the one year period Active Apparel Recruitment will fulfil any request by a candidate to remove their personal data from the database and files. The Act gives the candidate the right to access information held about themselves; on receipt of written request this will be provided free of charge by Active Apparel Recruitment.

Sharing of Data

Active Apparel Recruitment may disclose information to third parties:-

  • When introducing to clients, only with the candidate's permission
  • If the business is sold, or its assets, in which case personal data held will be one of the transferred assets
  • If the business is placed under a duty by a court order or arbitral order or in accordance with regulatory or professional requirements to professional bodies, authorised by statute to demand them or otherwise if required by law
